Terms of Use

Last updated: 19 October 2026

This is a machine translation. The Czech version is legally binding.

The Czech version of these terms is binding. Translations into other languages are machine-generated and are for information only; in the event of a conflict, the Czech version shall prevail, without prejudice to consumer protection under the legal provisions of the country of their habitual residence.

1. Operator and scope of the document

The Kimda app and family online service are operated by Mgr. Ivo Slávka, a sole proprietor, IČO 30070929, with registered office at Bergerova 1115/2, 182 00 Praha 8 – Kobylisy, Česká republika, registered in the Trade Licensing Register maintained by the Prague 8 Municipal District Office (hereinafter "the operator" or "we").

Contact for support, complaints, and contractual matters: support@kimda.app. Contact for personal data: privacy@kimda.app. Written correspondence may be sent to the registered office address.

This document describes the rules of the family online service and the statutory rights of users. Its contractual provisions are binding if they have been duly incorporated into the respective agreement: in the app, the Terms are accepted by an explicit act described in section 3. Mere publication on the website, confirmation of the Privacy Policy, or confirmation of the age of majority does not replace the acceptance of these Terms.

Separate relationships with the distribution store, in particular account management and payment processing, are governed by its terms. These do not replace the obligations of the service operator nor do they limit the user's statutory rights against them.

2. Purpose of the service

Kimda helps families plan household chores, keep track of virtual points and pocket money, create rewards and savings goals, and view family overviews.

Kimda is not a bank, a payment service, or an investment product. It does not hold, transfer, or invest users' money itself and has no access to their bank accounts or payment cards. Amounts, interest, and loans inside the app serve as a family record. The record itself does not determine the creation or validity of an actual obligation between family members.

The actual payment of pocket money and granting of rewards is decided by the respective family member. The operator is not a party to these family agreements.

3. Registration, acceptance of the Terms, family roles and children

3.1 Adult account and acceptance of the Terms. A family is set up by an adult. Upon registration, before creating an account, the adult shall explicitly accept these Terms in their own name by an active step (confirmation "I accept the Kimda Terms of Use in my own name") and may read their full text in the app and on the kimda.app website beforehand. The app records the version of the Terms, the language of the displayed text, the time of acceptance, and the corresponding hash (fingerprint) of the Czech version. For accounts created before the introduction of this step, or upon the release of a new version of the Terms, the app will offer acceptance via a one-time screen. Without accepting the valid version of the Terms, the service cannot be further used in the app; the user may log out and request account deletion.

Statutory consumer rights arise independently of these Terms. The role of "parent" is a technical designation of permissions in family management; it does not in itself prove the legal representation of every child or the authorization to act on behalf of another adult. A fully legally competent person acts in their own name regardless of the designation of their role.

3.2 Connecting a child and accepting the Terms on the child's behalf. A child is connected via a family invite; the child's account is created only after parental approval. The child does not accept the Terms themselves. Upon approval, the parent confirms the authorization of a legal guardian and consent to the processing of the child's data according to the Privacy Policy, and explicitly accepts the Terms on the child's behalf in the following wording: "I am the authorized legal guardian of this child. I accept the Kimda Terms of Use on the child’s behalf and enter into the agreement for use of the child account for them. I am not aware of any conflict of interest or restriction that prevents me from doing so. This does not oblige the child to pay for Premium." The app records which parent accepted the Terms for the child, the version, language, and time. For children connected before the introduction of this step, a one-time screen will offer acceptance to the parent.

Actual authorization to act is required to connect a child. The legal guardian must not represent the child in a potential conflict of interest or in breach of a restriction on their authorization; confirmation in the app does not replace the actual existence of authorization.

The payment for Premium is provided by the adult purchaser. The child does not incur an obligation to pay for the subscription merely by using their account. A change in authorization or legal capacity must be reported to support.

Connecting, accepting the Terms, confirming familiarization with the Privacy Policy, and consent under the GDPR are separate acts. Confusing them cannot replace missing legal conditions.

3.3 Security and family settings. Do not share the invite code and login details outside the designated persons. Connecting a new member requires approval in the app. The parent ensures the appropriateness of chores and rewards and supervision appropriate to the child's age. Every member must protect the privacy and rights of others.

4. Free tier and internal trial period

A new family gets a 60-day internal trial period with Premium features. It does not by itself create a paid subscription and does not lead to automatic billing.

Without a subsequent subscription, the free tier may be used for one active child and the basic chore flow: creation, completion, and parental approval. If the family has more than one active child, the parent chooses one for the free tier or renews Premium. The mere end of the trial period does not delete existing data, but limits the availability of paid features.

The trial period is granted once. Upon deletion of an account or a change of number of a parent who was a family member during the trial period, a hash (fingerprint) of the previous number is kept for 12 months to limit repeated use. Registration with the same number during this time will not receive a new trial period. The legal basis and right to object are described in the Privacy Policy.

Purchasing Premium during the trial period leads to the unlocking of paid features and the termination of the remaining part of the internal trial period. Upon subsequent expiration or refund, this remainder is not automatically reinstated. Statutory rights upon withdrawal and defective performance remain unaffected.

5. Premium, payments and renewal

Premium is an ongoing monthly or yearly digital service, not a one-time supply of digital content. It unlocks in particular money buckets, interest tracking, the planner, goals, rewards, loans, and parent overviews.

One subscription unlocks Premium for the family. The purchase takes place via the Apple App Store or Google Play. The specific offer and price are shown in the app's purchase screen and in the respective store's purchase dialog before binding confirmation.

The subscription automatically renews for further selected periods until renewal is cancelled. Renewal is cancelled in the settings of the respective store before the next renewal according to the displayed date. Upon mere cancellation of renewal, paid access generally continues until the end of the paid period. Withdrawal, a refund, or statutory termination of the contract may have a different consequence.

Deleting a Kimda account does not by itself cancel the subscription in the store. Check its renewal separately.

Cancelling renewal, withdrawal, complaints, refunds, and account deletion are not identical acts. The practical procedure of the store does not limit the statutory rights of the consumer. Rights against the operator may be exercised at support@kimda.app. If a refund requires the cooperation of the store, we will provide the necessary cooperation within the scope of our obligations and possibilities; the statutory claim is not excluded thereby.

6. Withdrawal from the paid contract

6.1 Time limit and submission. The consumer may withdraw from a distance paid contract within 14 days of its conclusion without giving any reason, unless applicable legal provisions stipulate otherwise. The time limit begins to run the following day. The statutory consequences of missing or delayed information are preserved.

Withdrawal may be made by any unequivocal statement to the operator, for example by e-mail to support@kimda.app or by letter to the registered office address. The form in the annex is optional. To meet the deadline, it is sufficient to send the notice in a timely manner. Provide the information necessary to identify the purchase; do not send login secrets.

6.2 Explicit request for immediate start. Before purchasing Premium in the app, the adult user shall, by a separate active step, explicitly request that the provision of Premium begin immediately after purchase confirmation, before the fourteen-day withdrawal period expires: "I explicitly request that Kimda Premium be provided immediately after purchase confirmation, before the 14-day withdrawal period ends. I understand that starting the ongoing service does not make me lose my right to withdraw, and that on withdrawal a proportionate price for the service already provided may be charged under the applicable legal conditions." Without this act, the purchase in the app cannot be initiated. The app distinguishes this act from the purchase confirmation in the store; cancelling, declining, or repeating the purchase does not replace the request. Proof of the request (time, selected plan, start of the paid period, store transaction identifier, and version of the displayed text) is stored by us in accordance with the Privacy Policy.

The mere unlocking of Premium does not void the right to withdraw. We do not rely on the exception for single-supply digital content; the statutory exception for a service requires its full performance and other statutory conditions, which the mere activation of a monthly or yearly access does not fulfill.

6.3 Consequences of withdrawal. Upon valid withdrawal, we will refund the received funds according to the law without undue delay, no later than within 14 days, using the same payment method unless another is explicitly agreed, without additional costs. If the consumer explicitly requested an immediate start before the purchase in accordance with section 6.2, a proportionate price for the part of the service already provided may be charged upon withdrawal under statutory conditions; without such a request, the proportionate charge is not applied. If the refund is to be provided by the store, we proceed according to section 5.

Paid access may end. Withdrawal from Premium is not by itself a request to delete the entire family. User content and personal data will be handled in accordance with the law. The rights to retrieve one's own content and rights under the GDPR are preserved.

Automatic renewal does not change the statutory start or existence of the right to withdraw. New orders and plan changes are assessed according to their actual contractual regime.

7. Functionality, availability, updates and changes to the service

Kimda is intended for supported mobile platforms and online family use. Logging in requires SMS phone verification; online features require an internet connection. The camera and notifications serve their respective features.

Statutory rights to the agreed quality, functionality, security, and continuity are not limited by the fact that absolutely uninterrupted operation cannot be guaranteed. For the duration of the commitment, we provide necessary updates and notifications of their availability. The consequences of failing to install them are governed by law.

Changing the service beyond necessary fixes is possible only under applicable statutory and contractual conditions, in particular for an agreed valid reason, without additional costs, and after clear notification. A reason may be, for example, a change in supported systems, security standards, legal requirements, or an essential technical provider.

In the event of a non-negligible deterioration of access or use, we will provide the statutory preliminary information in text form. The user may, under statutory conditions, terminate the commitment without penalty within 30 days of the notification or the implementation of the change, whichever is later. The exception for maintaining the original faultless performance and financial settlement are governed by law.

8. Complaints and defective performance

A complaint may be submitted to support@kimda.app or at the registered office address. State the defect and the necessary identification of the service; technical details and reasonable cooperation will aid resolution. Login codes or tokens are not needed.

We will issue a statutory confirmation of the receipt and handling of the complaint. A defect in an ongoing digital service can be claimed if it becomes apparent or occurs during the duration of the commitment. Its removal may be requested unless it is impossible or disproportionately expensive. The removal must take place within a reasonable time without significant inconvenience, taking into account the nature and purpose of the service.

A discount or withdrawal may be requested under statutory conditions, in particular in the event of failure to remove the defect, its reappearance, or a material breach of contract. Statutory rules apply to insignificant defects and the amount of the discount.

A complaint regarding a digital service is handled within a reasonable time according to its nature and purpose. Monetary amounts due from defective performance are refunded according to the law without undue delay, no later than within 14 days of the exercise of the respective right. In the event of a delay in providing access, statutory rights, including withdrawal, remain preserved.

9. Use and content

Do not use the service for unlawful conduct, harassment, disruption of operation, circumventing security, or unauthorized access to data. Only upload content with the necessary authorizations and protect the privacy of others. Do not upload inappropriate health or intimate data.

The user retains the rights to their content. The technical permission to store, secure, and display it corresponds to the duly agreed provision of the service; it is not a permission for advertising or public disclosure. Personal data is governed separately by the GDPR and the Privacy Policy.

The rights to the app, texts, graphics, and brand remain with their holders. Upon downloading from the App Store, Apple's licensing terms (standard, or custom if the operator specifies them in the store) apply alongside these Terms; the statutory rights of the consumer are not affected by these Terms or the licensing terms of the store.

10. Account termination and family management

An account can be deleted in the profile or its removal requested from support. Removal from a family is not automatically a full deletion of the account; the removed member may, after verification, request the removal of their own account.

When removing a parent or deleting a family, the family feature operates with a notification and a fourteen-day period for a response. The parent's refusal stops their removal; if the affected parent does not respond by the end of the period, the removal will be executed. Deleting a family in which there is another parent requires the explicit consent of each other parent; if not all consent by the end of the period, the request will expire and the family will be preserved. After the recent removal of another parent, a protective fourteen-day period runs, during which the family cannot be deleted. A request to delete the family submitted during this period will expire after its end along with the consents the parents have already given; it must be submitted again. Inaction does not constitute consent under the GDPR.

This mechanism does not limit individual statutory rights and their time limits. Disputes over authorization or conflicts of interest must be resolved individually. A virtual balance displayed before deletion is not in itself a legal decision on an actual debt.

In the event of a breach of obligations or a security risk, access may be restricted only to a justified and proportionate extent. Consumer rights and access to one's own personal data do not cease thereby. Planned termination of the service must respect agreed commitments, reasonable retrieval of one's own data, and statutory financial settlement.

11. Liability and personal data

The operator is not a party to family decisions on pocket money and rewards. This does not exclude liability for the service's own defects or breach of obligations, nor liability that cannot be limited by law.

The family role does not establish an unlimited right to obtain the data of other persons. Export is prepared via support and the administrator, not through a public self-service export interface. The scope and protection of rights are described in the Privacy Policy.

12. Changes to the document and contract

The publication of a new version does not by itself prove a change to an already concluded contract. A change to contractual provisions will take place according to the actually agreed mechanism and the law; for a new version of the Terms, the app will offer its acceptance by a new explicit act according to section 3. If the statutory regime for changing terms and conditions of long-term performance is used, we will ensure proper notification and the right to refuse the change and terminate the commitment without any special burdensome obligation. Special rights upon a change to the digital service remain preserved.

Confirmation of a new version of the Privacy Policy does not by itself mean acceptance of the Terms or consent to a new purpose of processing.

13. Governing law and dispute resolution

The choice of Czech law is effective only if validly agreed. It does not deprive the consumer of the protection afforded by mandatory provisions of the law that would otherwise apply, in particular under the Rome I Regulation. Statutory options for judicial protection are not limited.

We try to resolve disputes directly via support. For the out-of-court settlement of a regular consumer dispute with the operator, the competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce), internet address www.coi.cz, section dedicated to the out-of-court settlement of consumer disputes. In the event of an unresolved specific dispute, we will also provide information on a durable medium. The European ODR platform is not used for submitting complaints.

The statutory rights of the consumer take precedence over conflicting provisions. An unclear provision is interpreted more favorably to the consumer. The acceptance of these Terms is effective from the moment of acceptance and is not a retroactive confirmation of earlier use or representation of the child.

14. Annex: Withdrawal form

The use of the form is optional. Only fill it out if you wish to withdraw.
